Public restrictions are those that refer to zoning ordinances strictly under the state's police power. Furthermore, public regulations, governmental restrictions such as taxes, use of land, and growth development plans can also limit or restrict a landowners use of the property.

Private Restrictions on Real Estate


Private restrictions are established by land developers rather than actual public agencies and are comprised of both a burden to the land, as well as a benefit. In doing so, it is a burden to a landowner when the actual usage of the land by the landowner is restricted. In contrast, it is a beneift to the landowner when he or she has the right of enforcement against other landowners.
